The National Assembly is due to resume examining it tomorrow.Called Draft Law 105 and submitted on 5 January by National Assembly president José Muñoz and representative Agustín Sellhorn, both members of President Ricardo Martinelli’s Cambio Democrático party, the bill would add the following article (439-A) to the criminal code: “Anyone who, without grounds, insults, slanders or vilifies the President or any public servant holding an elected post will be punished by two to four years in prison.”This would violate the Declaration on Principles of Freedom of Expression that was adopted by the Organization of American States (OAS). Paragraph 11 of the declaration says: “Public officials are subject to greater scrutiny by society. Laws that penalize offensive expressions directed at public officials (…) restrict freedom of expression and the right to information.”We agree entirely with this principle. A public figure is by definition exposed to public comment and criticism. Punishing such criticism with imprisonment would be tantamount to introducing censorship and self-censorship. It would be incompatible with democratic principles.Ricardo Lombana of the National Journalism Council’s ethics committee called the bill “retrograde,” especially as it would target only insults against public servants. “This initiative is unconstitutional,” he said. “Insulting a public servant is not a crime. It is not defamation. It is just a lack of respect, which cannot be punishable by imprisonment.”Guido Rodríguez, the head of the Journalists Forum on Freedom of Expression, said: “This proposal is absurd and would destroy all the progress that has been made as regards freedom of expression.”Four bills affecting media rights and freedom of expression are currently before the National Assembly. One, introduced in October, would increase the maximum penalty for defamation from 18 months to five years in prison. Amid an increase in tension between the government and some of the media, two TV journalists were recently banned from practising their profession for one year . Nike is fighting back against Kawhi Leonard.The Clippers wing turned down a $22 million endorsement deal from Jordan Brand last October and elected to sign with New Balance in March. He then accused Jordan’s parent company, Nike, of claiming his patented “Klaw” symbol that appears on his branded apparel against his will. “In this action, Kawhi Leonard seeks to re-write history by asserting that he created the ‘Claw Design’ logo, but it was not Leonard who created that logo.”In his Complaint, Leonard alleges he provided a design to NIKE. That is true. What is false is that the design he provided was the Claw Design. Not once in his Complaint does Leonard display or attach either the design that he provided or the Claw Design. Instead, he conflates the two, making it appear as though those discrete works are one and the same. Golf clubs from all over Essex got together at their first county conference to discuss ways of growing the game.The Essex Golf Conference, at Langdon Hills Golf Club near Upminster, was the idea of County President, Mike Hart, who told delegates: “We need to work together to solve the problems of declining membership in our clubs and find ways to reverse the trend.”The event – which featured key speakers including David Joy, the Chief Executive of England Golf – was attended by about two-thirds of the county’s clubs, represented by 100 delegates, and it proved inspirational.Bradley Smith of North Weald Golf Club summed up when he said: “I would like to think I am forward thinking and do promote the game to all categories already.“However I left the conference thinking ‘Can I do what I am already doing better? and the answer is ‘Yes’. I also came away with various ideas which we will be slowly introducing to our marketing campaign.”Delegates heard from three speakers who shared their different experiences and offered advice on ways to recruit and retain members. They were: PGA Master Professional Alan Walker, whose Garon Park Golf Complex at Southend won the 2013 title of GolfMark Club of the Year; Simon Sheppard, PGA professional and Director of Golf at Bishop’s Stortford Golf Club, a private members’ club; and from Paul Densham, Director of Golf Operations at Essendon Golf Club, a proprietary club.England Golf, supported by local and national partners, is aiming to create more players, more members and stronger clubs, through its strategic plan, Raising our Game. David Joy spoke of the importance of a vision and an end goal when making changes. American Pharoah, the three-year-old thoroughbred star who has captured the hearts of racing and non-racing fans alike may spend part of his summer at the Jersey Shore.It’s expected, but not yet officially announced, that Pharoah, the Triple Crown winner will race in the Haskell Invitational on August 2 at Monmouth Park and since word of the superstar’s anticipated appearance travelled fast, the reserved seats at the race are already sold out. More than 90,000 people on June 6 saw the horse win the mile-and-a half Belmont stakes by five lengths to capture the first Triple Crown in 37 years. Some 60,000 people could pack Monmouth Park to watch American Pharoah at the Haskell with potential attendance and betting records set.Trainer Baffert is certainly no stranger to Monmouth Park. He has won four of the last five Haskell Invitational events and his horses always seem to run well at the Jersey shore. He won the Haskell in 2001 with Point Given; 2002 with War Emblem; 2005 with Roman Ruler; 2010-2012 with Lookin at Lucky, Coil and Paynter and with Bayern last year.American Pharoah’s owner Ahmed Zayat, an Egyptian-American who lives in Hackensack, indicated in interviews after the Belmont that he would like the horse to compete for the remainder of the 2015 season before standing at stud in Kentucky. Stud fees are expected to be $75,000 or even higher depending on how American Pharoah finishes in the Haskell and Breeders’ Cup.Monmouth Park announcer Frank Mirahmadi who called American Pharoah’s wins at the Rebel and Arkansas Derby during the lead up to the Kentucky Derby this spring says American Pharoah is a “super horse” and he would have been very surprised if he were upset at the Belmont.Mirahmadi predicted, even before the Belmont victory, that American Pharoah would race at the Haskell as the timing seemed right. What Mirahmadi along with other thoroughbred handicappers like to talk about is the rest period trainers like to have for horses between big races.The time between the Haskell and Saratoga (NY) Race Track’s classic Grade 1 Travers stakes Aug. 29, is four weeks. NEW YORK — The co-founder of Flipkart, the massive online retail operation in India acquired by Walmart this year, has stepped down as CEO following an allegation of serious personal misconduct.Walmart, which purchased a $16 billion controlling stake in Flipkart Group in May, the largest single investment in its history, said Tuesday that an independent investigation done on behalf of both companies did not find evidence corroborating the allegation against Binny Bansal, but it did reveal lapses in judgment on his part.Walmart cited “a lack of transparency, related to how Binny responded to the situation.”Kalyan Krishnamurthy, who took over as CEO of Flipkart in 2017, will continue in that role.Binny Bansal and Sachin Bansal —who are not related — founded Flipkart, India’s largest online retailer, in 2007.Walmart believes India, which has more than 1 billion people, could be among the world’s top five e-commerce markets within the next five years. Flipkart appeals to its customers for numerous reasons, including its various payment options. The company focused early on mobile phones, and in 2016 became the first app in India to reach 50 million users.Bangalore-based Flipkart has acquired a string of other companies in recent years, from fashion e-commerce company Myntra to mobile payment firm PhonePe. Its supply chain arm, eKart, serves hundreds of cities and makes at least 500,000 deliveries daily.Retailers based outside of India, including Walmart, have faced years of political resistance to opening outlets in the country, where mom-and-pop store owners wield enormous influence.
